General Terms and Conditions of Brainspotting Austria<\/h3><\/div>

1 Scope of the General Terms and Conditions (GTC)<\/strong><\/h4>\n

Unless expressly agreed otherwise, our General Terms and Conditions, which are made known
to you as the contractual partner, shall apply. The place of jurisdiction and place of fulfillment is
Vienna. You agree that in case of doubt, our terms and conditions shall apply if you use our
terms and conditions, even if your terms and conditions as a contractual partner remain
unchallenged. In this respect, acts of contract fulfillment on our part shall not be deemed as
consent to contractual conditions deviating from our conditions. If ambiguities nevertheless
remain in the interpretation of the contract, these are to be resolved in such a way that those
contents are deemed to have been agreed upon, which is usually agreed upon in comparable
cases. <\/p>\n

2. Admission to training<\/h4>\n
Brainspotting is a further training course for legally regulated health professions; in Austria, the
following professional groups are therefore admitted to trainings <\/p>\n
    \n
  • – Clinical psychologists and Health psychologists<\/li>\n
  • – Psychotherapists (must be listed on the list of the Federal Ministry)<\/li>\n
  • – Doctors in whose job description the use of the method can be integrated well<\/li>\n<\/ul>\n

    And of the colleagues in Germany, the following professional groups who are allowed to work in
    a healing capacity are admitted to Brainspotting trainings: <\/p>\n

      \n
    • – Alternative practitioners for psychotherapy<\/li>\n
    • – Psychological psychotherapists<\/li>\n
    • – Physicians.<\/li>\n<\/ul>\n

      3. Registration\/Booking<\/strong><\/h4>\n

      Registrations are binding. The reservation of training places is based on the order of registration
      and payment. Brainspotting Austria is entitled to refuse individual participants without giving
      reasons or to exclude them from further attendance of an event for good cause. In addition to
      your registration via web booking on our website https:\/\/brainspottingaustria.com\/, written
      registrations are also possible in exceptional cases by prior arrangement and, if necessary, by e-
      mail.
      Conditions of external organizers to which we may link on the website correspond to the
      respective applicable terms and conditions, which are beyond our control. <\/div>\n

      4 Terms of payment (invoice, due date, installments)<\/strong><\/h4>\n

      Invoices for training fees will only be sent electronically, by email as a PDF, to the email address
      provided during registration. You are responsible for ensuring that all electronic mailings by Brainspotting Austria (e.g. invoice, training information, etc.) can be properly delivered to the e-
      mail address you have provided.
      Unless otherwise agreed, our payment deadline is 14 days from receipt of the invoice. Each
      registration is a binding contractual offer that is accepted by sending a confirmation or the
      invoice for the relevant event (training, webinar, etc.). Irrespective of this, your place is not
      definitively secured until the invoice or any partial invoices have been paid in full. It is, therefore,
      essential that the entire fee is paid before the start of the event. Unless otherwise agreed, all
      amounts are due for payment upon receipt of the invoice at the latest.
      Installment payments can only be negotiated before the start of the event. In the event of late
      payment, we reserve the right to charge reminder fees and default interest of up to 15% of the
      purchase price. Discounts cannot be deducted. Only written agreements shall apply. <\/p>\n

      5 Cancellation fees<\/strong><\/h4>\n

      The written declaration of withdrawal must be sent to:

      Cancellations after registration are subject to the following cancellation fees: <\/p>\n

        \n
      • – Cancellations free of charge are possible within 14 days of registration (right of withdrawal),
        unless the event starts within 14 days of registration.<\/li>\n
      • – Cancellations between the 15th day after registration and 30 days before the start of the
        training will be charged 20% of the training fee.<\/li>\n
      • – Cancellations made between 29 days and 7 days before the start of the training will be charged
        50% of the training fee.<\/li>\n
      • – In the event of cancelations from 6 days before the start of the training up to the first day of the
        training or in the event of non-participation without deregistration, 100% of the training fee must
        be paid.<\/li>\n<\/ul>\n

        If a person is nominated in good time to attend the training in your place, the cancellation fee will
        be waived as soon as a contract of the same name is concluded with the person concerned.
        If participants move up from the waiting list, we will charge a processing fee of \u20ac 40.00.
        The above cancellation fees apply regardless of the reason for the cancellation. The cancellation
        date is when Brainspotting Austria receives the written cancellation. <\/p>\n

          \n
        • – Webinars \/ reflective teams are not refundable due to their low cost.<\/li>\n<\/ul>\n

          6. Revocation<\/strong><\/h4>\n

          You have the right to withdraw from the contract within fourteen days without giving any reason.
          The withdrawal period is fourteen days from the day on which you received the booking
          confirmation from us.
          If you withdraw from this contract, we shall reimburse to you all payments received from you,
          including the costs of delivery (except any supplementary costs resulting from your choice of a
          type of delivery other than the least expensive type of standard delivery offered by us), without
          undue delay and in any event not later than 14 days from the day on which we are informed
          about your decision to withdraw from this contract. For this repayment, we will use the same
          means of payment that you used for the original transaction, unless expressly agreed otherwise
          with you; under no circumstances will you be charged any fees for this repayment.
          To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising
          your right of withdrawal before the withdrawal period has expired. To exercise your right of
          withdrawal, you must inform us of your decision to withdraw from this contract employing a
          clear written declaration. You can send us an e-mail for this purpose. <\/p>\n<\/div>

          -Name of the consumer(s)
          -Address of the consumer(s)
          -Signature of the consumer(s) (only in case of notification on paper)
          -Date
          (*) Delete as appropriate.<\/p>\n<\/div>

          7. Protection of material (copyright) or privacy (clients)<\/h4>\n

          All material provided by us (e.g.: training schedule, presentations, access links and similar)
          remain our – intellectual – property at all times. Any use, in particular the passing on,
          reproduction, publication and making available, including the copying of extracts, requires our
          express consent.
          All of the above-mentioned documents can be reclaimed by us at any time and must be returned
          to us immediately without being asked if the contract is not concluded.
          As a contractual partner, you undertake to maintain confidentiality vis-\u00e0-vis third parties with
          regard to the knowledge you obtain from the business relationship. This applies in particular and
          above all when dealing with sensitive client data (case discussions, etc.), even if their
          identification features have already been changed by individual persons (participants in trainings, supervision, etc.) in the interests of data protection and to the best of our knowledge
          and belief.
          Audio and video recordings during the training sessions are not permitted.
          If our contractual partner creates and provides us with documents or services that enjoy legal
          protection, including copyright protection, in the absence of an express agreement to the
          contrary, the contractual partner shall grant us an unrestricted but non-exclusive right of use to
          these works or such a right shall be deemed to have been agreed.
          Brainspotting Austria reserves the right to take legal action in case of an infringement. <\/p>\n

          8. Protection of privacy \/ personal health<\/h4>\n

          The privacy of other training participants (no disclosure of personal data to the outside world) or
          clients (case descriptions) must always be respected and protected to the highest degree.
          Participation in a Brainspotting event is at your own risk. You must be willing to participate in
          self-awareness exercises and be able to know\/preserve your own boundaries and accept those
          of others. <\/p>\n

          9 Certificates and confirmations<\/h4>\n

          Training certificates can be downloaded from your account after completing the course. We do
          not issue certificates for webinars. Certificates of participation for the Reflective Team are
          collected and issued every six months. Other time or deposit confirmations can be issued on
          request in individual cases. <\/p>\n

          10 Cancellations and changes<\/h4>\n

          Brainspotting Austria is entitled to cancel an event if the number of participants is too low or for
          other compelling reasons (e.g., the speaker’s absence due to illness). Travel and\/or
          accommodation costs or other expenses will not be reimbursed, but participation fees will be
          refunded.
          Brainspotting Austria also reserves the right to change events in terms of duration, content,
          location, date, or price should this become unavoidable for organizational reasons. Affected
          persons will be informed in such cases. In the event of price changes, there is no right to \u201cequal
          treatment\u201d compared to previous bookings for the same course; the prices advertised on the
